NSW: Cyclist run down by car sues councils for leaving out bin

A cyclist who's brain damaged after he was run down by a car is suing a northern New
South Wales council for leaving a garbage bin on a bike track.

ADEN PAUL GLASCOTT, now 20, is suing Byron Shire Council for damages caused during
the accident on Bangalow Road at Byron Bay in February 1998.

He is claiming more than $750,000 in damages.

Mr GLASCOTT swerved onto the road from the bicycle track to avoid a wheelie bin, and
rode into the path of an oncoming car.

The New South Wales Suprenme Court has been told he suffered leg and head injuries,
despite wearing a helmet, and now suffers from memory loss, has concentration problems
and walks with a limp.

The driver of the car, JON RUTLEDGE, has made an out of court settlement with Mr GLASCOTT
for an undisclosed amount.
