NSW:Bats to be evicted after failed legal bid
A massive colony of flying foxes will be evicted from Sydney's Royal Botanic Gardens
.. after an animal welfare group's failed Federal Court bid to allow them to stay.
Bat Advocacy had challenged a decision by then federal Environment Minister PETER GARRETT
to approve the relocation of up to 22 thousand threatened grey-headed flying foxes.
The Royal Botanic Gardens and Domain Trust says the animals are destroying an important
species of trees and palms .. and plans to blast the bats using loud industrial noise
.. which has been successfully used in Melbourne's Royal Botanic Gardens.
Federal Court Justice DENNIS COWDROY has rejected the challenge .. saying Mr GARRETT
had properly considered the issues .. and ordered Bat Advocacy to pay the minister's and
the trust's costs.
